Terms of Service

These terms are an agreement between you and Ideas to Integers, a studio operated by Alisa Roberts ("we", "us"), covering your use of Breezy Weather at breezyweather.app and any related pages. By using the app you accept these terms. If you do not accept them, please do not use the app.
Breezy Weather is not an emergency service. Read the Weather Safety Disclaimer, which forms part of these terms and limits what you may rely on this app for.
1. Who may use Breezy
Breezy is free to use for personal, non commercial purposes. You must be at least 13 years old. If you are under the age of majority where you live, you may use Breezy only with the involvement of a parent or guardian.
2. Our intellectual property
The Breezy Weather application, including its source code, design, layout, user interface, illustrations, logo and written copy, is the original work of Ideas to Integers and is protected by copyright. All rights not expressly granted are reserved.
We grant you a personal, limited, revocable, non exclusive, non transferable licence to use the app as it is provided. That licence does not permit you to:
- copy, reproduce, republish or redistribute the app or its design;
- create derivative works, including a competing or substantially similar app;
- remove, hide or alter any copyright, trademark or attribution notice;
- reverse engineer the app other than as permitted by applicable law;
- sell, licence, rent or otherwise commercialise any part of it;
- use the name or logo in a way that suggests we endorse you.
The Breezy Weather logo and its associated artwork are original works of Ideas to Integers, claimed as unregistered marks. We make no claim to exclusive rights in the words "breezy" or "weather" on their own, and this app is not affiliated with, endorsed by, or connected to any other product, project or company using a similar name. Weather data remains the property of its respective providers.
3. Acceptable use
You agree not to:
- use automated tools to scrape, crawl or bulk download from the app;
- place unreasonable load on the app or on the data providers behind it;
- attempt to gain unauthorised access to any system or account;
- interfere with, disrupt or attempt to disable the service;
- circumvent any security or rate limiting measure;
- use the app for anything unlawful, or in breach of a data provider's terms.
4. Third party data and services
Forecasts, alerts, air quality and radar come from third parties listed on our Data Sources page. We do not create, control or verify that data. Their availability and accuracy are outside our control, and their own terms apply to the data they supply. We may change or remove a data provider at any time.
5. No warranty
Breezy Weather is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non infringement. We do not warrant that the app will be uninterrupted, timely, secure or error free, or that any forecast or alert will be accurate.
6. Limitation of liability
To the fullest extent permitted by law, Ideas to Integers and anyone associated with it will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, property, or for personal injury or death, arising out of or relating to your use of or inability to use Breezy Weather, whether based in contract, tort, negligence, strict liability or otherwise, and whether or not we were advised of the possibility of such damages.
Where liability cannot lawfully be excluded, our total aggregate liability to you for all claims is limited to the greater of the amount you paid us to use Breezy Weather in the twelve months before the claim, or ten United States dollars. Because Breezy is free, that amount will normally be ten dollars.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for personal injury or for gross negligence or wilful misconduct. In those places, the exclusions above apply only to the extent permitted, and nothing in these terms limits rights you have that cannot be waived by agreement.
7. Indemnity
You agree to indemnify and hold harmless Ideas to Integers from any claim, demand, loss or expense, including reasonable legal fees, arising from your misuse of the app, your breach of these terms, or your violation of any law or of the rights of a third party.
8. Availability and changes
Breezy is offered free of charge and we may change, suspend, limit or discontinue it, in whole or in part, at any time and without notice or liability. We may update these terms; if we do, the date at the top of this page changes and material changes will be announced in the app. Continuing to use Breezy after a change means you accept the revised terms.
9. Termination
You may stop using Breezy at any time and delete its local data from the Profile menu. We may terminate or restrict your access if you breach these terms. Sections 2, 5, 6, 7, 10 and 11 survive termination.
10. Governing law and disputes
These terms are governed by the laws of the State of Indiana, United States, without regard to its conflict of laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Marion County, Indiana, for any dispute not required to be resolved elsewhere by applicable law. If you are a consumer resident in a jurisdiction that guarantees you the right to bring proceedings locally, this clause does not remove that right.
11. General
If any provision of these terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy and the Weather Safety Disclaimer, are the entire agreement between us about Breezy Weather.
